California is a comparative negligence state and what that means is that the fault of everybody who is involved in causing an injury is compared and your recovery is reduced for your share of fault. Now in other states, it’s their contributory negligence states, which means that if you as the injured person are 51% at fault then you recover nothing. In California, we found that that’s an unfair outcome and that a more realistic and fair outcome, based on the people that are involved, is comparative fault.
