What is Negligent Security?

Video Transcript

Negligent or inadequate security can be grounds for a premises liability case in California. A negligent or inadequate security case typically involves a circumstance where the property owner knows, or should know, that there is a danger on their property. For example, there may have been assaults, unsafe conditions, or other circumstances that might cause a reasonable property owner to know that they need to hire security or monitor the premises.

Examples of a negligent or inadequate security case include poor or undertrained security guards, a lack of security guards, poor or dim lighting in an area, broken locks, or an unsecured area that a reasonable resident might expect to be secure. These are all circumstances where a property owner could be held liable for negligence.
