Tragically, cases involving swimming pool negligence usually involve the death of a young child and drownings, typically due to failure to properly fence, gate, or monitor small children. In California, a swimming pool is considered a dangerous condition, which means the property owner or landowner has a responsibility to protect people from the dangerous condition or the pool.

This responsibility extends even to someone who would be considered a trespasser, such as a child wandering onto the property. Property owners are responsible for making sure that child is safe, which is why it’s important for folks to fence their swimming pools.
