Gyms have responsibilities under the law to maintain safe premises for their customers, and that includes their equipment. They have a responsibility to make sure the equipment is well-maintained, well cared for, and inspected to ensure that it’s not becoming damaged from overuse or misuse by customers.

An example of a gym liability case our firm had: we once represented a man who was using a machine at the gym when the metal cable snapped. The cable snapped because the gym failed to maintain the machine and conduct regular inspections to make sure that the metal of the cable maintained its integrity. As a result of the snapped cable, our client was hurt. That’s an example of premises liability in a gym context.

But there are other circumstances in which a gym could be held liable. For example, a spill of something left out, uneven walkways, or weights left in places that folks could trip on—those are all risks that occur at gyms.
