Restaurants can be liable for premises liability. They have the same obligations as other businesses in California to keep their restaurants free from hazards, free from negligent things that could be a danger to their visitors that are there to dine. One example of a premises case that I’ve had at a restaurant involved a restaurant that had slick tile in front of the building, and an elderly woman went to eat that day, and it rained, and she slipped on the tile and broke her hip. And that’s an example of the restaurant failing to make sure that their premises are safe at all times, including the conditions like the weather. In an ideal circumstance, I’d have tile that’s safer for outdoor weather, but that can’t always happen. So restaurants can be liable for premises liability under California law.
