Premises liability is a legal concept that holds a property, property owner, or manager responsible for harms and injuries that occur on the premises. In order to successfully succeed in a property or premises liability case, you need to first show that there was a duty—that the property owner or manager owed you a duty of reasonable care.

Second, you need to show breach. You need to show that the property owner or manager breached their duty of care, typically by doing something negligent.

Third, you need to show causation. You need to show that the breach of their duty of care, or their negligent action, caused you harm.

Lastly, you need to show damages. You need to show that you suffered an actual injury as a result of their harm. If you are able to meet all of these criteria and establish that the premises was operated negligently, then you can succeed on a premises liability theory of law.
