How Much are Trip and Fall Claims Worth?

Video Transcript

The value of trip and fall cases varies depending on the severity of a person’s injury and the severity of the negligence involved. On the low end of the spectrum, if a person slips and falls and isn’t hurt, they might theoretically sue, but if they did not actually suffer any lasting injuries, they likely would not have a viable case. On the high end of the spectrum, someone might slip or trip and fall and suffer a significant injury.

For example, our firm represented a man who was at a convention and was walking down a pedestrian sidewalk when he tripped and fell on the metal foot of a temporary fence. Due to the way he fell, he actually snapped his neck and became an incomplete quadriplegic as a result of the injury. As a result of that case, he received an eight-figure settlement. That is a circumstance where a trip and fall case might have a high value, whereas if you slip or trip and fall and scrape your knee, your case would have a very low value.

Some factors that contribute to the value of a slip and fall or trip and fall case include your medical expenses. Did you have to go to a doctor or the hospital? Did you have any lasting issues? Did you need physical therapy or other therapies as a result of your injury? Did you miss work, resulting in lost wages? Did you have any medical expenses or bills that were unpaid by your insurance company? Did you need to hire someone to help care for you or a family member?

Did you need assistance around the house with cleaning, laundry, or yard maintenance? These are all considered economic losses that would contribute to the value of your case.
