Can You Sue a City for Bad Roads/Potholes? | Cutter Law Explains

Video Transcript

We’re frequently asked what level of accountability is there for the government when they provide dangerous roadways. The government is responsible for providing its property in a reasonably safe manner. That means that they need to inspect their property. They need to identify dangerous conditions, and they need to timely fix them.

I’m currently helping a young woman who was a sophomore at a local UC campus. She was riding her bike home at night and she was hit by a car in a dangerous intersection that the state of California, the university, and the local city all knew to be dangerous. All of them knew that it was dangerous and they all failed to take steps to protect this young woman as she was riding home. You’re talking about a scholarship athlete.

We’re talking about someone who the sky was the limit, and she’s hit by a car, and she suffered a catastrophic brain injury. And to this day, the governmental entities are refusing to accept responsibility, but we’re not allowing them to do that.

And we’ve come to a place where we’ve been able to prove they knew exactly how dangerous the road was. They knew exactly why it was dangerous. And they knew it was just a matter of time until a young woman like our client was injured at that location. We’re currently holding them accountable.
