Can You Still File a Lawsuit If You Weren’t Wearing a Helmet?

Everyone should wear a helmet, but if you’re not wearing a helmet and you get hurt while riding a bicycle, you can still bring a lawsuit depending on whose fault it is and what your injuries are. If you’re not wearing a helmet and someone doors you and you break your leg, you can still bring a lawsuit because a helmet wouldn’t have protected your leg anyway. But if you get hit on the head, if you’re not wearing a helmet, you’re placing yourself in a riskier spot. And so you want to do everything you can to protect yourself because a jury is going to be asked to compare your fault with the fault of the person that hit you. And so a jury might consider you to be more at fault if you weren’t wearing a helmet.
