Uber and Lyft are popular ride-hailing companies. Although they classify their drivers as contractors, that doesn’t mean they’re not responsible if one of their drivers is involved in a car accident.
How responsible they are for an Uber driver accident or a Lyft driver accident depends on the circumstances of the accident.
If you are an Uber passenger or a Lyft passenger and you are involved in a car accident, you may be eligible to file a claim against the company. If you are a pedestrian, cyclist, or motorist and are involved in a Lyft accident or Uber accident caused by one of their drivers, you may also be eligible to file a lawsuit.
Uber Accident Claims
Uber reportedly carries a $1 million policy that kicks in when an Uber driver is in the process of transporting an Uber passenger. If you are in an Uber car accident while you are a paying passenger, you can file a claim against the Uber car insurance policy.
If, however, the insurance company denies your claim, you may be eligible to file a lawsuit against Uber.
Because Uber’s drivers are classified as independent contractors, preparing a strong case for the insurance company or lawsuit is vital. That’s where an experienced Uber accident lawyer can help you.
Other motorists, pedestrians, or cyclists can also be Uber victims, depending on the circumstances of the accident.
If you are injured in an accident while an Uber driver has a paying passenger, you can file an insurance claim Uber lawsuit against the company. If you are injured while the driver is between passengers, you may still be able to file an Uber accident lawsuit.
In 2015, Uber tentatively settled a lawsuit filed by the family of a six-year-old girl who died on New Year’s Eve in 2013 when she, her brother, and mother were hit by an Uber driver while they were crossing the street.
Although Uber initially claimed it was not responsible for the accident because the driver, Syed Muzzafar, was not carrying passengers, the family argued that because he was logged into Uber’s app at the time of the accident, the company was responsible.
The terms of the Uber settlement were kept confidential at the request of the victim’s family.
Lyft Accident Claims
The Lyft car insurance policy is similar to Uber’s. Lyft carries an insurance policy of $1 million to cover passengers who are injured in an accident while in a Lyft car. The company also carries a policy in case of underinsured or uninsured drivers. That policy allows for up to $100,000 per Lyft accident.
Also similar to Uber, your ability to file an insurance claim may depend on the circumstances of the accident. If you were a passenger, or if you were a motorist, pedestrian, or cyclist and were injured by a Lyft driver while they had a paid passenger in the vehicle or while they were between passengers, you can file an insurance claim or a Lyft accident lawsuit.
An experienced Lyft accident lawyer can help you prepare your case against the ridesharing company.
