Fault in a truck accident, no different from any motor vehicle accident, is determined based on how people acted, whether they acted reasonably. In truck accidents, we commonly see fatigue being a huge factor. Drivers are forced to work super long hours and don’t always take the breaks that they’re required to because of the pressure they’re under. So, it’s not uncommon to have drivers nod off. That can lead to catastrophic consequences.

We also, all know that in California, we’ve got a lot of traffic and it’s much harder for trucks to stop, and so, we have traffic stopping, suddenly a truck that hasn’t maintained adequate distance, and bam. So, those are some of the examples of fault in truck accident cases. We also see cases of trucks coming on and merging without seeing the car next to them. If you can imagine it, it’s happened.
