When should you report a nursing home or a residential care facility for the elderly? There’s no cost to you to report an issue. You don’t expose yourself to any liability for saying “Hey, I think something’s going on here. We need some eyes on this.” And so really, if you see something, you should just report it and then the regulators will get involved and they’ll take a look and they can make their own determination on whether or not they think your report has any merit. But, it’s important to remember that even if a regulator says “Everything’s okay here,” that doesn’t mean that you don’t have a case. Often times people think that because the regulator said that everything was kosher at the facility that they don’t have a case, and that’s not true. When you hire a lawyer, they’ll take a deeper dive into your loved ones medical records and make an independent determination about the specific care that your loved one received and whether or not you actually have a case.
