The Save Mart wage theft class action is about Save Mart forcing managers and assistant store managers, who are on a salary job, to take on all of the responsibilities of the hourly employees at their stores.

Save Mart short-staffs their stores. They don’t have enough butchers, enough deli clerk workers, enough janitors, or enough clerks checking people out. And so, they force the store managers, the people who are ultimately responsible for running the stores, to do the jobs of three, four, or sometimes five or more other people.

They underpay the managers, and they are able to save on labor costs because they just don’t hire enough people to do the jobs that need to be done.

That is in direct violation of California law. And Save Mart’s known that because they’ve done this before, and they’ve settled a prior litigation where they’ve been held accountable for doing exactly the same thing.
