Very often in medical malpractice lawsuits, you’ll hear the other side say, ‘Well, you signed a consent form.’ You never consent to somebody acting unreasonably. You consent to somebody acting reasonably and to the consequences that are unavoidable in a procedure.
We know that medicine can be risky. We know that outcomes aren’t guaranteed. But we expect—and we have a right to expect—that all medical practitioners exercise reasonable care, have that level of knowledge and care, and apply it as reasonable practitioners would.
So no, you do not give up your rights just because you signed a consent form.
