If a potential client thinks they have a mass case, they’re going to call our firm. And we have a wonderful team of case managers who know a lot about the initial litigation and what kinds of questions to ask and what to look for. So, they’re going to ask a series of questions that they know to be pertinent to the litigation and gather that information.
Assuming that we sign the case, we’re next going to send them a retainer, give them a copy, and order all of the medical records and any other pertinent information for their potential claim. Any attorney filing a mass tort case may not necessarily have full control over when trials are scheduled or how quickly litigation may move because of how many cases are filed in a mass tort. Which is why it is really important to have an attorney who understands what a mass tort is because of the added complexities of a case.
It’s not exactly something they’ve taught you in law school. It’s something that you’ve learned with practice, and you can understand the intricacies of an attorney who has to file their cases, but they’re not the ones leading the litigation and working with that group of attorneys that are leading the litigation because we’re all working toward the same goal, which is to successfully resolve a case for our clients.
