The question was: How much compensation can I get if I’m a victim of medical malpractice? And the answer depends on what your damages are, because in California, general damages are capped—that means your pain and suffering damages. So, depending on the year when your case goes to trial, that could be capped at anywhere from, say, half a million dollars to a million dollars, even for wrongful death. However, if you have economic harm—for example, as a result of medical negligence you can’t work anymore—you can get all of your loss of earnings, past and future, added to that. And if you have additional medical expenses as a result of being harmed, those can be added to the award. So, the award can—the thing that’s capped are the general damages though, in California at least.
