Lyft Sexual Assault Lawsuit

Lyft, Inc., faces a sexual assault lawsuit filed by 14 women alleging they were victims of sexual assault while using the Lyft app and that the ride-sharing company mishandled their sexual assault, sexual misconduct and rape claims against drivers paid by Lyft.

Furthermore, the lawsuit alleges that Lyft knew about drivers committing misconduct and other sexual crimes against female passengers since 2015.

Driver For Lyft; Rape Allegations

Lyft, another ride-hailing company, also faces allegations its drivers have assaulted or raped passengers. One lawsuit was filed by a San Antonio woman, who alleges Lyft acted with “flagrant and malicious disregard” for her safety.

The lawsuit names both Lyft and its driver as defendants. Lyft has said the driver’s account was deactivated once it learned of the sexual assault complaint.

In a different lawsuit against Lyft filed in 2015, a woman in Chula Vista alleged a Lyft driver followed her into her home and groped her against her will. As with other lawsuits, the victim alleged Lyft did not do enough to protect her from harm committed by her driver.

Women’s Allegations of Lyft Sexual Assault Terrifying

The women’s accounts of Lyft driver sexual assault are made worse by Lyft’s lack of response when the incidents were reported, in some cases allowing the drivers to continue even after receiving complaints. 

The incidents included in the Lyft rape lawsuit occurred between January 2018 and June 2019 and include victims from California to North Carolina. Among the complaints were violent sexual assaults and thefts against numerous women who used the Lyft app thinking they would be given a safe ride home.

Lyft Failed to Enact Proper Screening or Training

As a company, Lyft does not conduct adequate screening, interviewing or background checks to ensure its drivers do not have criminal records or a history of violence. The company also does not use its technology to ensure passenger safety and does not require drivers to undergo non-harassment training. 

To strengthen passenger protection, Lyft could:

  • Adopt a background check that includes fingerprinting applicants
  • Have a zero-tolerance policy regarding misconduct
  • Conduct surveillance of all rides and require drivers to leave the system on at all times
  • Inform drivers that they may not leave their vehicles to accompany passengers except for time-limited situations
  • Require drivers to report their reason for leaving their route
  • Adopt a mandatory reporting policy in which all sexual assault claims are reported to police

Lyft Rape Lawsuit Alleges Ride-Sharing Company Puts Women at Risk

Among the complaints in the lawsuit are that Lyft misleads the US public the high number of reported rapes and sexual assaults that occur in Lyft vehicles.

Additionally, the lawsuit claims that in a one-year period before May 2016 there were almost 100 reports of Lyft drivers committing sexual assault against passengers in only one state. 

“Lyft’s response to this sexual predator crisis amongst Lyft drivers has been appallingly inadequate,” the lawsuit states. “Lyft continues to hire drivers without performing adequate background checks. Lyft continues to allow culpable drivers who have complaints of rape and sexual assault lodged against them to keep driving for Lyft.

And, most importantly, Lyft has failed to adopt and implement reasonable driver monitoring procedures designed to protect the safety of its passengers. As a consequence, Lyft passengers continue to be victims of sexual assaults and rapes by Lyft drivers.” 

Despite receiving numerous complaints about Lyft sex crimes, the company has not enacted even basic procedures for investigating such reports.

It also has not provided records or documentation that police need to conduct their own investigations and has been called “unresponsive” by police. Frustratingly, Lyft allegedly erases complaints from its app, preventing victims from retrieving their original complaint.

When victims report sexual assault or rape, Lyft frequently disables their account while allowing the alleged perpetrator to continue working for the company.
